Please read the following terms of use carefully before registering, accessing, browsing, downloading duNOW (herein referred to as “The Product"). By accessing or using the product or by using the service, you agree to be bound by these terms and conditions set forth below including any additional guidelines and future modifications. If at any time you do not agree to these terms and conditions or do not wish to be bound by these terms and conditions, you may not access or use the product and immediately terminate your use of the services by suspending your account (Please refer Privacy policy foot note under section "Contact Us").
The terms and conditions (as may be amended from time to time, the "Agreement") is a legal contract between you (herein referred to as "You"); the beneficiary of this product and Razorback Technologies Private Limited (herein referred to as “The Company or duNOW”) having its registered office at C/4, Yamuna Flats, 16th Street, Nanganallur, Chennai – 600061. “The Company” reserves the right, at its sole discretion, to revise, add, or delete portions of these terms and conditions any time without further notice. You shall re-visit the "Terms of use" link from time to time to stay abreast of any changes. You represent and warrant that you are at the least 18 years of age and have the right, authority, and capacity to enter into this agreement and abide by all terms and conditions. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity.
This license granted to you for “The Product” by duNOW, is limited to a non-exclusive, non-transferable, license to use on any Android/iOS device that you own or control and does not allow you to use it on devices that you do not own or control, and you may not distribute over a network where it could be used by multiple devices at the same time.
Nothing contained in the “The Product” should be considered as granting you, by implication or otherwise, any license or right to use any trade-marks, logos, or other names. You may not rent, lease, lend, sell, redistribute or sublicense “The Product”. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of “The Product”. Any attempt to do so is a violation of the rights of duNOW and its rightful owners. If you breach this restriction, you may be subject to prosecution and damages. The terms of the license will govern any upgrades provided by duNOW that replace and/or supplement the original “Product”, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern its use.
In order to use “The Product”, “You” must register by providing your first name, last name, email address, phone number, postal code and any additional information that may be required such as bank name, account number etc. In some cases if required, we may ask you to send us additional information, such as a copy of your driver's license or passport, or to answer additional questions to help us verify your identity. The information that you provide will be used by us to determine if you are eligible to begin and/or continue to use “The Product”.
You are responsible for: (a) keeping your account login information, passwords & pin secure (b) maintaining the confidentiality of your account login information, passwords & pin, (c) any and all transactions by persons that you give access to or that otherwise use your account login information, passwords & pin, and (d) any and all consequences of use or misuse of your account login information, passwords & pin. You agree to notify us immediately of any unauthorized use of your account or any other breach of security in using services of duNOW. You also agree that you will ensure to keep your personal information accurate and up-to-date at all times. If you have reason to believe that your account is no longer secure (e.g., in the event of a loss or theft of your mobile device or unauthorized disclosure or use of your account id, pin, password) you agree to immediately notify duNOW and indemnify duNOW from any liabilities that may arise from the misuse of your account.
You acknowledge and agree that your purchases of goods/services through duNOW are transactions between you and the business and NOT with duNOW. duNOW does not guarantee any service levels or quality promised by the business. You acknowledge and agree that it would be your responsibility to verify the credibility and reliability of the business that you interact with prior to any commercial transaction. duNOW does not offer any shipping or logistic service. You acknowledge and agree that any refunds that you seek due to deficient service or lack of promised quality is between you and the business and NOT with duNOW.
You acknowledge and agree that you are authorizing duNOW as an intermediary to initiate electronic transfer request to debit money from your linked bank / debit card / credit card account the amount you specify to business via our duNOW financial institution partner (Banks or Payment Gateway). You are solely responsible for complying with any terms set by your linked bank/ credit card provider with respect to your account, including any fee terms, such as insufficient fund or overdraft fee terms. You further agree that it would be your responsibility to check with the business to confirm receipt of your payment – 3 days after the date of transaction. In event of negative acknowledgement of receipt of your payment from the participating business; please reach out to us at payments@dunow.net for us to look into the issue and resolve at no charge. You acknowledge and agree that duNOW reserves the right to impose transaction limits on transactions between you and the business.
You acknowledge and agree to allow duNOW send (via email) a transaction receipt to the email address that you have shared with us at the time of registration. duNOW is under no obligation to you if a business requires additional proof of purchase in connection with a transaction made by you with the participating business.
You acknowledge and agree duNOW will not provide you with a separate periodic statement for your use of “The Product”. An electronic transaction history showing all transactions is available free of charge in the “The Product” and you are responsible for reviewing the account transaction history.
You agree to pay duNOW for the intervention time it spends (@ 1 INR/3 minutes) to resolve any disputes between you and the business.
You further agree not to use “The Product” in any manner to harass, abuse, stalk, bully, threaten, defame, impersonate, gamble, exhibit or transmit sexually explicit, pornographic, pedophilic content, promulgate hate speech, carry out illegal activities or otherwise infringe or violate the rights of any other party or other users of “The Product”. In event of any violation; duNOW and its licensors, reserve the right to change, suspend, remove, or disable access to “The Product” at any time without notice.
In no event shall duNOW or any of its subsidiaries or affiliates be liable to you or any person for any direct, indirect, special, consequential or other damages (including, without limitation, any lost profits, business interruption, loss of information or programs or other data on your information handling system) that are related to the use of, or the inability to use, the services and functions of the “The Product”.
You agree to indemnify and hold harmless duNOW, its subsidiaries and affiliates from any claim, cost, expense, judgment or other loss relating to your use of “The Product”, including without limitation of the foregoing, any action you take which is in violation of these terms and conditions.ability to use, the services and functions of the “The Product”.
If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions to be unenforceable, the remainder of these terms and conditions will continue in full force and effect.
